Concealed Weapon Permit

The Judith Basin County Sheriff's Office provides concealed weapon permits to those who qualify. To obtain a permit you must be 18 years old, a resident of Judith Basin County, provide all necessary information, pass a criminal background check, and the permit must be approved by the Sheriff. Other requirements must be met. You must apply in person at the Sheriff's Office located in the Judith Basin County Courthouse. Please read the following sections of the Montana Code Annotated: 45-8-321.

New permits $50.00
For a new permit you will need to provide your Montana driver's license and your social security number. A current photo is required, so you will have to come to the Sheriff's office to get a new permit.

Renewal permit $25.00
For a permit renewal you must provide us with your existing permit card. A current photo is required, so you will have to come to the Sheriff's office to get a permit renewed.

Please read the following sections of Montana Code Annotated regarding concealed weapons:

45-8-327. Carrying a concealed weapon while under the influence. A person commits the offense of carrying a concealed weapon while under the influence if he purposely or knowingly carries a concealed weapon while under the influence of an intoxicating substance. It is not a defense that the person had a valid permit to carry a concealed weapon. A person convicted of the offense shall be imprisoned in the county jail for a term not to exceed 6 months or fined an amount not to exceed $500, or both.

45-8-328. Carrying concealed weapon in prohibited place
(1) A person commits the offense of carrying a concealed weapon in a prohibited place if the person purposely or knowingly carries a concealed weapon in:
     (a) portions of a building used for state or local government offices and related areas in the building that have been restricted;
     (b) a bank, credit union, savings and loan institution, or similar institution during the institution's normal business hours. It is not an offense under this section to carry a concealed weapon while:
          (i) using an institution's drive-up window, automatic teller machine, or unstaffed night depository;
          (ii) at or near a branch office of an institution in a mall, grocery store, or other place unless the person is inside the enclosure used for the institution's financial services or is using the institution's financial services.
     (c) a room in which alcoholic beverages are sold, dispensed, and consumed under a license issued under Title 16 for the sale of alcoholic beverages for consumption on the premises.

(2) It is not a defense that the person had a valid permit to carry a concealed weapon. A person convicted of the offense shall be imprisoned in the county jail for a term not to exceed 6 months or fined an amount not to exceed $500, or both.

Burn Permit

Burning in a burn-barrel is permitted if the barrel is clear from vegetation and is covered with a screen. A burn permit is not required. Open burning is allowed by permit only. The permit will be issued free of charge if conditions are suitable for burning. You may obtain a permit for open burning by visiting:

This process ensures that burning is done only under favorable conditions, as well as to ensure that fire department response is not requested unnecessarily. Call the Judith Basin County Sheriff's Office at 566-2212 with questions.

76-13-121. Permit for burning required.
(1) During the wildfire season or an expansion of the wildfire season, a person may not ignite or set a fire, including a slash-burning fire, land-clearing fire, debris-burning fire, or, except as provided in subsection

(2), an open fire without an official written permit to ignite or set the fire from the recognized agency for that protection area.
     (a) If no restrictions are in place, a permit is not needed for recreational fires measuring less than 48 inches in diameter that are surrounded by a non-flammable area or structure and for which a suitable source of extinguishing the fire is available.
     (b) A recreational fire may not be ignited if special restrictions prohibiting recreational fires have been established by an authority having jurisdiction.
